A woman’s complicated divorce and custody battle has taken a surprising turn, leading to financial repercussions that her ex-husband likely didn’t anticipate. The story, shared on a popular online forum, highlights the legal maneuvers that unfolded after years of abuse and control.
After the birth of their first child, the woman says her ex-partner pressured her to quit her job, citing the need for her to care for their family. However, when the couple’s second child was just two years old, she discovered her ex’s infidelity, which marked the beginning of a tumultuous and abusive relationship that would lead to her taking drastic steps to protect herself and her children.
In 2012, after her ex-husband allegedly abused their firstborn, she decided she could no longer tolerate the situation and forced him out of their home. With no financial support from him and no family to lean on for help, she struggled to make ends meet. Her ex vehemently refused to provide any monetary assistance, stating that the courts hadn’t ordered him to do so. This refusal ultimately led her to take legal action.
It took six months and a court ruling for her ex to be ordered to pay child and spousal support, a considerable amount of $2,562 per month. However, he refused to comply until the courts began garnishing his wages, which left him about $6,000 in arrears by that time. This financial strain forced her to relocate further away, seeking a fresh start.
The woman remarried a year after her divorce, believing that the spousal support would be safe since the court documents did not indicate otherwise. Instead of filing for her share of her ex’s retirement account, she decided to take the amount she was owed for spousal support and move on. The arrangement seemed reasonable at the time, given the circumstances.
However, in 2017, her ex filed for sole custody of their children without warning. This unexpected move revealed his realization that he had been paying her spousal support during her first year of marriage. In response, she reiterated that she had chosen to keep the spousal support rather than pursue his retirement funds. He then demanded repayment of that support, leading to further legal battles.
Despite the court ordering her to repay the overpaid spousal support, the judge increased her child support, which effectively resulted in her getting an extra $20 a month. Eventually, her ex dropped his custody bid, negotiating for more time with the children during the summer instead.
Despite the perceived victory, her ex was not finished. He refused to cooperate over the division of his retirement account, a move that extended the legal battles for four years. His lack of compliance led to sanctions against him, which included an additional payment of $600 a month for an entire year, on top of his child support obligations. Furthermore, he faced contempt charges for his repeated failures to follow court orders.
In January 2021, he proposed to his new girlfriend, but by May of the same year, the woman finally received the disbursement from her ex-husband’s 401(k). To her shock, the amount was about four times greater than the spousal support she had initially received, more than she could have imagined when she opted for that over filing for his retirement.
Adding a twist to the saga, her ex’s fiancé reached out, accusing the woman of sabotaging their relationship by depleting his retirement account. She explained that it was her ex who had chosen to take the legal route to reclaim his assets, pushing her to file for the division of the retirement funds. In her eyes, the ex’s choices had led to his current situation.
Despite her attempts to reason with the fiancé, who suggested a prenup instead of blaming her, the discussion revealed the bitterness remaining in the aftermath of the divorce. The woman’s stance was clear. She had tried to negotiate fairly but was met with deceit and aggression. In the end, her ex’s refusal to accept responsibility for their financial agreements cost him far more than he bargained for during their custody and support disputes.
As the dust settles, the woman is left pondering the complex dynamics of her past relationship and whether to view it as a personal victory or simply a consequence of her ex’s decisions.
